This is the first of a multi-part fiqh course dedicated to a careful study of al-Imam al-Marghinani’s renowned work of legal commentary, al-Hidaya. This first part focuses on introducing the premises and principles of Hanafi thought, and how these premises and principles are applied when studying Hanafi legal doctrine. The arguments presented in the Hidaya will be carefully analysed to show how the text really does convey a science of jurisprudence, and how a methodical approach to the text prepares one for the highest levels of legal reasoning. This first part of the course aims to give a high level of reading literacy in the Hidaya which will support personal study greatly for those not continuing with the full course. *RECORDINGS ONLY*
Description: In view of the aims of the course stated above, the reading of this first part will be slower than subsequent parts of the full course. The second part will be a quicker reading, in which we will cover the remainder of kitab al-salat, kitab al-zakat, kitab al-sawm and kitab al hajj. Subsequent parts will cover the remainder of the book. Recordings and resources shall be available on the course homepage and forums. Please note that this course has now ended and registration provides you with access to the recordings and resources.
Instructor: Shaykh Dr. Sohail Hanif
Sohail Hanif works on Islamic legal theory, with a focus on the Ḥanafī school of law. He received a MA and DPhil from the University of Oxford. His doctoral thesis, A Theory of Early Classical Ḥanafism: Legal Epistemology in the Hidāyah of Burhān al-Dīn ‘Alī ibn Abī Bakr al-Marghīnānī (d. 593/1197), studies the interplay of rationality and tradition in a major work of legal commentary. Sohail has also spent over a decade in Jordan where he studied a full curriculum of Islamic sciences with traditional ‘ulamā’. He was previously Head of Arabic Sciences at Qasid Arabic institute in Amman, an instructor in Islamic studies at Qibla online academy, and has taught undergraduate classes on Modern Islam and Qur’anic studies at the University of Oxford.
